Ohio Prepaid Entertainment Contract Compliance. To the extent applicable, this Agreement is intended to comply with all requirements of Chapter 1345 of the Ohio Revised Code relating to prepaid entertainment contracts. Any provision of this Agreement that is determined to be inconsistent with any non-waivable requirement of applicable law shall be modified and construed to the minimum extent necessary to comply with such law, and all remaining provisions shall remain in full force and effect. Customer shall have all cancellation, refund, and other rights expressly required by applicable law, and no provision of this Agreement shall be construed as a waiver of any right that may not be waived under applicable law. You have the right to cancel this Agreement until midnight of the third (3rd) business day after the date on which the first service under the Agreement is available to you. If the facility or services that are the subject of this Agreement are not available when you sign the Agreement, you may cancel this Agreement until midnight of the seventh (7th) business day after you receives the first service available under the Agreement. Notice of cancellation may be delivered in person, by manual delivery, by certified mail (return receipt requested), by facsimile transmission, or by electronic mail to West Side Bunker, LLC at the address, facsimile number, or electronic mail address specified below. Notice of cancellation need not take any particular form and is sufficient if it indicates Buyer's intention not to be bound by the Agreement. If you timely cancel this Agreement as provided above, West Side Bunker, LLC shall refund all amounts that you paid under the Agreement, except that West Side Bunker, LLC may retain a reasonable expense fee not exceeding Ten Dollars ($10.00) if you have received the first service under the Agreement. West Side Bunker, LLC shall also cancel and return any note, negotiable instrument, or other evidence of indebtedness executed by you in connection with the Agreement as required by applicable law. If West Side Bunker, LLC relocates the facility covered by this Agreement twenty-five (25) miles or more from your residence, or if you relocates your residence twenty-five (25) miles or more from the facility, you may be entitled to cancel this Agreement and receive a prorated refund to the extent required by applicable Ohio law. All information and material of a personal or private nature that is acquired directly or indirectly from you including but not limited to, answers to tests or questionnaires, photographs, or background information, shall be returned by West Side Bunker, LLC to you by regular mail within thirty days after the expiration of the contract or after the expiration for any reason of the service to be rendered by West Side Bunker, LLC. if by reason of death or disability, you are unable to receive benefits from West Side Bunker, LLC’s services, the contract shall be proportionally divided by all of the days in which the facility was made available to you as part of the contract offering, and you shall be liable for payments only for that portion of the contract that can be attributed to the period prior to your actual death or disability, exclusive of any period of time in which the facility was made available to you free of charge as part of the contract offering, and West Side Bunker, LLC, within thirty days after receiving notice of the death or disability, shall return to you or your representative the amount paid in excess of the proportional amount. Performance of the contract will begin no later than one hundred eighty days from the date the contract is entered into. You are not required to pay more than fifty dollars or ten per cent of the total contract price, whichever is the lesser amount, prior to the date on which the facility or service that is the subject of the contract is available for use by you. NOTICE OF CANCELLATION You may cancel this contract for any reason at any time prior to midnight of the third business day after the date on which the first service under the contract is available, and if the facility or services that is the subject of the contract is not available when you sign the contract, you may cancel the contract at any time prior to midnight of the seventh business day after the date on which you receive your first service under the contract. If you cancel within this period, the seller must send you a full refund of any money you have paid, except that a reasonable expense fee not to exceed ten dollars may be charged if you have received your first service under the contract. The seller must also cancel and return to you within twenty business days any papers that you have signed. To cancel this contract you must deliver in person, manually, by certified mail, return receipt requested, or by facsimile transmission, the signed and dated copy of this cancellation notice or any other written notice of cancellation, or send an electronic mail message, to (name of seller), at (the address of any facility of the seller available for use by the buyer, the seller's facsimile number, or the seller's electronic mail address) not later than midnight of the third business day after the date on which the first service under the contract is available, and if the facility or service that is the subject of the contract is not available when the contract was signed, not later than midnight of the seventh business day after the date on which the first service under the contract is available. I hereby cancel this contract.

West Side Bunker Liability Waiver and Release Agreement IMPORTANT – PLEASE READ CAREFULLY To ensure a smooth and safe experience, all guests are required to sign a waiver before playing golf on the simulators located at West Side Bunker. Assumption of Risk I, the undersigned Participant, understand and acknowledge that participation in indoor golf simulation activities at West Side Bunker involves inherent risks, including but not limited to, risk of personal injury, property damage, or other harm. These risks may result from the use of golf equipment, swinging clubs in confined spaces, slips or falls, errant shots, physical exertion, and interactions with other participants. I voluntarily and knowingly assume full responsibility for all risks associated with my presence at West Side Bunker and my participation in any activities or use of the facilities, including risks caused by the negligence of participants, other patrons, or the facility. I am not relying on West Side Bunker, LLC to guarantee my safety while participating or using the facility. Health and Fitness to Participate I certify that I am in good health and have no physical or medical condition that would prevent me from safely participating in indoor golf or using simulator equipment. I understand that I am solely responsible for determining whether I am physically fit to participate. I agree to inform West Side Bunker of any medical conditions or limitations that may impair my ability to participate safely. Release of Liability In consideration for being permitted to access and use the facilities at West Side Bunker, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, waive, and discharge West Side Bunker, LLC, its owners, officers, directors, employees, agents, contractors, affiliates, successors, and assigns (collectively, the “Releasees”) from any and all liability for any injury, loss, damage, or claim, including those caused by the negligence of the Releasees, arising out of or in connection with my participation in any activity, event, or use of the facilities (the “Released Claims”). This waiver also extends to any third-party contractors or service providers used by the facility. Covenant Not to Sue I agree not to initiate or assist in any legal action, lawsuit, or claim against the Releasees relating to any of the Released Claims. I also agree not to bring any claims before any court, administrative agency, or arbitration forum, whether local, state, or federal. Indemnification I agree to indemnify, defend, and hold harmless West Side Bunker, its owners, officers, directors, employees, agents, contractors, affiliates, successors, and assigns from any and all claims, damages, expenses, or liabilities, including attorney’s fees, arising from my actions or negligence while participating in activities or using the facilities. Medical Treatment Authorization In the event of an injury or medical emergency while on-site, I authorize West Side Bunker and its staff to secure emergency medical treatment as deemed necessary. I certify that I have adequate health insurance coverage or accept full financial responsibility for any medical services rendered on my behalf. I also agree to be responsible for any and all costs associated with medical treatment. Conduct and Facility Use I agree to abide by the posted Rules and Regulations and Code of Conduct of West Side Bunker, which are available on the company’s website. I understand that failure to comply with these rules and regulations may result in suspension or termination of my access to the facility without refund, and may include legal action if the breach results in harm or damages to other participants, the facility, or property. Guest Responsibility Clause I understand that I may bring guests with me to West Side Bunker to participate in activities, including the use of the golf simulators. I acknowledge that I am fully responsible for the behavior, safety, and actions of all guests I bring onto the premises. I agree to ensure that all guests I bring comply with all rules, regulations, and codes of conduct of West Side Bunker. I further understand that I am responsible for any injuries, damages, or losses caused by my guests while on the premises, including damages to the facility, equipment, or injury to other participants. I agree to indemnify, defend, and hold harmless West Side Bunker, LLC, its owners, officers, directors, employees, agents, contractors, affiliates, successors, and assigns (collectively, the “Releasees”) from any and all claims, liabilities, damages, or costs arising out of or in connection with the actions or omissions of any guest I bring to the facility. Photography and Media Release I irrevocably grant West Side Bunker the right to photograph or record my participation in activities for promotional and marketing purposes, including but not limited to digital media, advertisements, and social media, unless I specifically opt out in writing. I understand that these images and recordings may be used in various forms of media without further compensation or approval. Severability If any provision of this agreement or any portion of the release is found to be invalid or unenforceable, the remaining provisions of the agreement and the remaining release provisions will continue in full force and effect. I understand that the invalidity of any part of this waiver will not affect the enforceability of the remaining terms. Governing Law and Venue This Liability Waiver and Release Agreement shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles. Any legal action, suit, or proceeding arising out of or relating to this Agreement shall be instituted exclusively in the courts of Hamilton County, Cincinnati, Ohio. The Participant and the Releasees hereby consent to the personal jurisdiction and venue of such courts, and waive any objection based on inconvenient forum or any other jurisdictional or venue-based objection. Alcohol Use I understand and agree that the consumption of alcohol is permitted at West Side Bunker, provided it is done responsibly and in moderation. I acknowledge that I am responsible for my own actions while consuming alcohol, and I will not engage in behavior that compromises my safety, the safety of others, or the enjoyment of the facility’s activities. I further understand that West Side Bunker reserves the right to refuse service, suspend, or terminate my access to the facility if I am deemed to be intoxicated, disruptive, or otherwise incapable of participating in activities safely. Zero Tolerance Substance Use I understand and agree that the use of illegal drugs, controlled substances, or any other substances that impair judgment or physical ability is strictly prohibited at West Side Bunker. There is a zero-tolerance policy for substance use at the facility, and I acknowledge that any participant found using or under the influence of such substances will have their access to the facility immediately terminated without refund. I further agree that West Side Bunker reserves the right to take any necessary actions, including involving law enforcement, if illegal drug use or other substance abuse is suspected. I understand that my participation at West Side Bunker is contingent upon compliance with this policy. Weapons Prohibition I understand and agree that weapons of any kind, including but not limited to firearms, knives, or any other objects that may be used to cause harm, are strictly prohibited on the premises of West Side Bunker. I acknowledge that bringing a weapon onto the property is grounds for immediate removal from the facility and may result in notification of law enforcement. I agree to indemnify, defend, and hold harmless West Side Bunker, LLC, its owners, officers, directors, employees, agents, contractors, affiliates, successors, and assigns (collectively, the “Releasees”) from any and all claims, liabilities, damages, or costs arising out of or in connection with the possession or use of any weapon on the premises. Minor Participation West Side Bunker acknowledges that participants under the age of 18 (minors) may be present and participate in activities at the facility. By allowing a minor to participate, the adult responsible for the minor agrees that they are fully financially responsible for the minor’s actions, safety, and compliance with all facility rules, regulations, and codes of conduct. The responsible adult understands and agrees that they accept all risks associated with the minor’s participation, including injuries, damages, or losses, and that West Side Bunker, LLC, its owners, officers, directors, employees, agents, contractors, affiliates, successors, and assigns (collectively, the “Releasees”) are released from any liability arising from the minor’s participation. This clause applies automatically to all minors and does not require a separate signature. Credit Card Authorization for Damage I accept full financial responsibility for any damage caused by me or any of my guests, minors, or people I have invited to use the facility with my reservation, whether resulting from intentional acts, misuse, reckless behavior, negligence, failure to follow facility rules, or lack of supervision. Without limiting the generality of the foregoing, (1) The parent or guardian agrees to reimburse Westside Bunker for the cost of repair or replacement of damaged property. (2) I hereby authorize West Side Bunker, LLC to charge the credit card or payment method associated with the reservation for any documented damage caused by me or any of my guests, minors, or people I have invited to use the facility with my reservation. If the payment method cannot be charged, I agree to pay the amount due within ten (10) days of receiving notice.
